You expressly agree not to use the Service to:

• Generate, distribute, or store content depicting individuals under the age of 18, or that could be reasonably interpreted as depicting minors
• Upload photos of any person without their explicit informed consent
• Generate content for commercial distribution, resale, or monetization without a separate commercial license agreement
• Harass, defame, or create non-consensual intimate imagery (NCII) of real individuals
• Circumvent, disable, or interfere with security features of the Service
• Attempt to reverse engineer, scrape, or extract the underlying AI models
• Use automated means (bots, scrapers) to access the Service without authorization
• Violate any applicable law or regulation, including those relating to privacy, intellectual property, or obscenity

Violation of these prohibitions may result in immediate account termination, reporting to relevant authorities, and civil or criminal liability.

5. Content and Intellectual Property

All AI-generated content produced by the Service is synthetic and fictional. No real persons are depicted in AI-generated outputs. You acknowledge and agree that:

• Generated content is provided for personal use only
• You retain no intellectual property rights over generated outputs that would supersede our rights in the underlying models
• You are solely responsible for any use you make of generated content
• We do not endorse, review, or take responsibility for how you use generated content

6. Uploaded Content

By uploading a photo to the Service, you represent and warrant that:

• You own the photo or have obtained all necessary rights and consents to upload and process it
• The photo depicts an adult (18+) and does not include any minors
• Processing the photo through the Service does not violate any applicable law or third-party rights

You grant us a limited, temporary, non-exclusive license to process the uploaded photo solely for the purpose of generating your requested output. This license terminates immediately upon deletion of the photo, which occurs automatically after processing.

7. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that:

• The Service will be uninterrupted, error-free, or available at all times
• Generated outputs will meet your specific requirements or expectations
• Any errors in the Service will be corrected

8. Limitation of Liability

To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with your use of the Service, even if we have been advised of the possibility of such damages.

Our total aggregate liability for any claims arising out of or related to these Terms or the Service shall not exceed the amount you paid for the Service in the twelve months preceding the claim, or USD $100, whichever is less.

9. Indemnification

You agree to indemnify, defend, and hold harmless cumface-generator.xxx and its operators, officers, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or relating to your use of the Service, violation of these Terms, or infringement of any third-party rights.
